Our lawyers recently assisted an MoD employee who suffered a personal injury in an accident at work caused by a hazard in his workplace.
The claimant was employed at the Ministry of Defence driving school of transport. Both military personnel and civilian employees used a large door at the end of one of the hangars and there was no alternative route available.
On the day of the claimant’s workplace accident there had been heavy rain and part of the hangar, including an area up to several feet outside of it, was flooded with several inches of water.
As he walked through the hangar door the claimant slipped and fell, which caused him to sustain a personal injury. He decided to make a compensation claim, so appointed The Legal Line’s specialist lawyers, who are experts in claims against the Ministry of Defence to represent him.
Although there was a drain in place in the centre of the hangar, this was only effective for light rain conditions. During and after heavy downpours the water would collect.
It was clear the MoD recognised that drainage was important for safety, as the original drain was there to remove the water. After the claimant’s fall, a private company was also brought in to keep the drains clear.
The Judge found 100% in favour of the claimant as, although there had not been previous complaints about the condition of the hangar, the MoD were aware of the potential hazard and did not have any risk assessments or systems of cleaning in place.
