Personal Injury Claim for Moped Accident Caused by Road Defect

Defects on public roads can be dangerous to motorists as well as pedestrians. Our lawyers recently secured compensation for a man who suffered a personal injury in a moped accident caused by a large hole in the road surface.
Road Accident
Our client was riding along a main road within a city centre at the time of his accident, travelling well within the speed limit. The front wheel of his moped dropped into a sizeable hole, causing the rear wheel to leave the road and lift up into the air before coming back down again with force. As this road accident occurred during the evening, the pothole was not easily visible until our client was upon it.
Although he was able avoid being thrown off the moped altogether, our client suffered a back injury. He had to take time off from work and required medical treatment, including a course of physiotherapy.
Claim Against Local Authority
Following his accident our client contacted the local authority responsible for the road and they arranged for the hole to be filled in. He felt that his accident could have been prevented if the road was maintained to a safe standard to begin with and he therefore appointed our expert lawyers to assist him in making a personal injury claim.
We contacted the local authority to begin a claim, however they denied liability and it was necessary for us to pursue the case to trial. Our evidence showed that, although they had made monthly inspections of the road, the defect was hazardous and in a high traffic area and it should have been repaired.
The Judge found in favour of our client and he was awarded damages in respect of his injury, loss of earnings and other financial losses.
