A council employee suffered serious injuries in a fall at work whilst using a ladder. Our expert personal injury lawyers represented him in a compensation claim against his employer.
Our client worked at a school and he and his colleagues were decorating some of the rooms. He was painting and used the ladders he was provided with in order to reach higher areas of the walls.
No risk assessment had been carried out for the job, there was no supervision, and our client was not trained on the use of ladders or correct procedures for painting. The ladder he was given was also unfit for purpose.
The ladder slipped from underneath him and he fell from a height of around 10 feet. As a result of this accident at work his ankle was fractured, his foot was dislocated and the tendons and ligaments in his ankle were torn. He also suffered a dislocated shoulder, and wounds to his knee and face which required stitches.
These injuries required extensive medical treatment, including surgery. Our client was previously very active, but during his recovery he could not work or enjoy his social and leisure activities. He also had to rely on his wife for assistance with personal care.
The injured employee felt that his accident could have been avoided if he was provided with the relevant training and a platform instead of a ladder, which would have been the correct equipment for the task.
We acted on his behalf in a personal injury claim against his employer. They accepted primary responsibility for the accident and we negotiated a settlement of compensation. Our client received a sum in respect of his injuries and also his financial losses, including the costs of care, medical treatment and transport he incurred because of the accident.
