Compensation Claim for Nerve Damage Caused by Vibrating Tools

19th December 2008

Our lawyers assisted a man who suffered a personal injury due to his excessive use of vibrating tools at work and secured compensation on his behalf.

Industrial Injury

The claimant worked on a production line, fitting wheels to agricultural vehicles by using a pneumatic air gun to tighten the bolts. The gun was vibratory and heavy and he used it constantly throughout his shifts. There was no system of job rotation in place and he was not given any protective equipment to use.

He began to experience tingling, numbness and cramps in his hands and fingers and found that he was no longer able to grip effectively. After seeking medical advice our client was told that the nerves in his arms were affected. He required operations on both arms and underwent extensive physiotherapy treatment. This offered some improvement but he has been left with ongoing problems.

Claim Against Employer

He appointed our expert personal injury lawyers, who are specialists in workplace injury and industrial disease cases, to assist him in making a claim against his employer. Our medical expert gave evidence that his injuries were related to his exposure to vibration.

Initially the defendants denied that the condition was caused by his working conditions and they refused to negotiate a settlement. Court proceedings had to be commenced and our lawyers recovered in excess of £16,500 damages for the claimant.
