Occupational Asthma Compensation for Recycling Centre Worker

Exposure to Dust and Fumes
Our client was employed at a recycling centre, where various processes took place. Through this work he was exposed to strong fumes from composting, wood dust, other dusts, gases and chemicals. He was not made aware of any health risks and was not given advice on any precautions he should take.
He began to suffer respiratory problems, persistent coughing and a running nose and his symptoms were worse when he was at work. He was diagnosed with occupational asthma and also rhinitis. Our client now has to use inhalers each day.
Industrial Disease Claim
We represented the employee in a personal injury claim against his employer. He was one of several employees at the same facility who suffered respiratory illnesses. We asserted that the company could have done more to protect the health and safety of their employees, such as providing adequate personal protective equipment or dust suppression measures.
Our client’s employer denied that they were responsible, but we continued the case and were able to secure an offer of compensation. The first offer was lower than we felt was acceptable however, so we negotiated for an increase. Our client received damages in the sum of £6,000.
