We recently acted in a compensation claim on behalf of a former pupil support worker, who suffered noise induced hearing loss due to working with loud woodworking machinery.
Our client was employed by a local authority, providing pupil support in a design and technology department. He was exposed to hazardous levels of noise over several years from machinery including sanders, lathes, bandsaws and an air handling unit.
He was not provided with any hearing protection, or information about the risks of hearing damage. Our client developed industrial deafness and tinnitus in both ears and now requires hearing aids. This affects his work and social activities.
The claimant instructed our specialist personal injury lawyers to pursue a claim against his former employer on his behalf. We put forward evidence of the damage to our client’s hearing and also witness evidence from a colleague about the hazardous working conditions.
The defendants admitted liability and put forward an initial offer, but this did not fully reflect the impact our client’s condition had on his life and the costs he incurred for purchasing and maintaining hearing aids. We began court proceedings, but it was possible to negotiate a suitable settlement before the case went to court and we secured £10,000 in damages for our client.
