Employee Suffers Personal Injury Due to Unsafe Work Equipment

30th October 2009

A sports centre employee sustained a back injury in an accident at work due to an unsafe set of steps that his employer failed to repair or replace. Our lawyers handled a personal injury claim on his behalf and he received compensation.

Accident at Work

In the course of his work our client was removing a set of metal steps from a swimming pool, so that a pool cleaning machine could operate. The steps are fixed into the floor at the side of the pool by metal collars which they slot into. Unfortunately the collars were corroded, making it difficult to lift the already heavy steps out.

As he struggled to lift the steps out he felt a sharp, stabbing pain in his lower back. He went on to be diagnosed with a prolapsed disc and he required treatment including physiotherapy, traction and spinal injections. Our client had to take a lot of time off from work and was eventually medically retired due to the problems with his back.

Compensation Claim

Our client did not believe his employer took all the health and safety measures they could to ensure he had a safe workplace. He therefore felt they were responsible for his personal injury and asked our lawyers to represent him in an injury claim.

The other side initially refused to put forward a suitable offer of compensation, so we had to commence court proceedings. We were able to negotiate satisfactory terms before the case went to trial however and our client received over £33,000 in damages.
