Our specialist personal injury lawyers recently acted on behalf of a woman who suffered neck and shoulder injuries due to an accident in a shop.
At the time of her accident, our client was browsing the aisles in a popular hardware store. Suddenly, a stack of thick rubber doormats on a high shelf fell towards her and struck her head and shoulder, causing a personal injury.
There was a lot of soft tissue damage which unfortunately was resistant to treatment suggested by the client’s doctor. Her condition improved over time but she was left with some degree of pain, discomfort and restriction that is likely to be permanent. The client felt that her capacity to work was restricted as a result of the accident. She also had difficulty with activities such as driving, gardening and doing housework.
The claimant felt that her accident was caused by a lack of health and safety measures in the store. The high shelf, without a shelf guard to prevent stock from falling, was unsuitable for the heavy doormats, especially as the stack could easily become unstable if any of the mats were moved or knocked by customers.
She therefore appointed our lawyers to assist her in making a personal injury claim. We entered into negotiations with the other side and rejected early offers of compensation as they did not reflect the level of injury sustained by our client. Eventually we were able to secure a settlement of £20,000 in damages.
This compensation took into account both the pain and suffering our client was put through and also her financial losses, including her loss of earnings, travel expenses, medication costs and expenses for help with tasks she would previously complete herself.
