A build up of pigeon droppings on the pavement beneath a railway bridge caused a woman from Wandsworth to suffer a serious personal injury, when she slipped on them and fell to the ground.
She was able to make a successful claim for compensation after appointing our expert personal injury lawyers, who are specialised in accident claims.
In May 2003, Lois Matcham was walking under a railway bridge in Battersea. There was an ongoing problem at the time wfth pigeons roosting underneath the bridge, as their droppings would leave the pavement below in an unsafe condition.
Several complaints had been made by local residents, however no satisfactory action had been taken by Network Rail or Wandsworth Council to resolve the problem.
Ms Matcham slipped on some of the droppings and fell, fracturing her left upper arm, near to the shoulder. When a passing police officer stopped to assist her after witnessing the accident, he too slipped and narrowly avoided a fall.
The claimant instructed our specialist lawyers, Thompsons Solicitors, to assist her in making a claim. It was put forward that Wandsworth Council were responsible for keeping the pavement clean and safe and Network rail had a duty to maintain the railway bridge.
Ms Matcham, aged 64, was awarded damages of £20,000 in respect of her injuries. As she is also an artist, her injuries affect her sculpting and she suffered a lot of pain as a result of the accident.
Her lawyer, Kim Bouwer, commented on Ms Matcham’s case: “Medical experts have predicted that the fracture will never entirely unite and that she will be left with some disability in her arm on a long term basis. The compensation is therefore wholly justified."
