A former mechanic suffering from the asbestos-related disease, pleural thickening, recovered compensation in a recent personal injury claim, with help from our specialist personal injury lawyers.
Our client developed chest pain, difficulty breathing and repeated chest infections after he retired. He underwent tests at hospital and was diagnosed with extensive pleural thickening and also mild asbestosis. These conditions left him with only 50% lung capacity and permanent respiratory disability.
He was exposed to asbestos in the course of his employment with a number of different companies. As a teenager he worked as a plater, manufacturing steel tanks. The tanks would be lagged with asbestos by his colleagues who were working nearby and there was a lot of asbestos dust present in the atmosphere at the factory.
Later, the claimant went on to work as a mechanic for various employers and he mainly serviced commercial vehicles. This work involved regular contact with asbestos brake linings, clutch plates and gaskets containing asbestos and he would use a compressed air gun to blow away the dust. No protective wear or ventilation was provided, despite the fact that the environment would become very dusty.
The claimant enlisted the help of our expert lawyers, who specialise in industrial disease cases, to make a personal injury claim in respect of his illness.
Details of his asbestos exposure were collated and the case was pursued against several of the companies that he worked for. Claims for asbestos-related illnesses can be difficult and complicated, due to the length of time that has often elapsed between asbestos exposure and the onset of diseases, so there are considerable benefits of using a firm of solicitors with extensive experience in such cases.
The case was successful and our client received £35,000 in damages. This sum was in respect of the pain and suffering caused by his illness and also in consideration of his requirements for care and assistance.
If you or a member of your family has been affected by an illness caused by exposure to asbestos, such as pleural thickening, asbestosis, mesothelioma or lung cancer, you may be entitled to claim compensation.
