Our specialist personal injury lawyers recently recovered compensation for a driver, who was injured in a road accident when his vehicle hit an unmarked skip.
The claimant was driving along a main street in dark, rainy conditions at the time of his accident. An unmarked skip was obstructing part of the road and he did not see it until it was too late to avoid a collision.
As a result of the impact our client was thrown forward violently in his seat and he suffered whiplash injuries and injuries to his head, chest, hand and knee. A self-employed plasterer, he was unable to work for several weeks and for a period when he returned to work he could only carry out lighter duties. The injuries also affected his ability to play sports and look after his garden and he was more anxious when driving for a few months after the accident.
The injured driver approached us for help with a personal injury claim, as he felt the skip was dangerous to road users and this caused his accident.
We investigated the matter and found that regulations stated the skip should have been guarded by traffic cones and that lamps, coloured paint and reflective strips should have marked both ends. We pursued a claim against the people responsible for leaving the skip in the road and initially they were unwilling to put forward an acceptable offer of damages. We therefore commenced court proceedings, however through negotiations we were able to secure a sum of compensation for our client before the case went to trial.
