School Employee Suffers Back Injury in Accident at Work

In a recent case handled by our specialist personal injury lawyers, a man suffered a back injury at work due to a lack of safety and was awarded compensation.

Accident at School

Our client was employed at a primary school and he was asked to erect a shelving unit by his employer. This was not a normal part of his work duties, however he was not given any training or instruction on how to safely complete the task and no equipment was provided. As the shelves were over 6 feet tall when constructed he requested some step ladders, but none were provided and he was told to stand on a cushioned chair instead.

When he was constructing the upper shelves, it was necessary for our client to stretch onto his tiptoes in order to fit the pieces into place. As he exerted pressure to pull a metal bar into place, with his arms above head height, he felt severe pain in his back.

As a result of his accident at work, the claimant had to attend hospital and his GP surgery and it took approximately 2 months for the majority of his symptoms of his personal injury to subside.

Injury Compensation Claim

The claimant instructed our lawyers to pursue a personal injury claim on his behalf.

It was necessary to pursue the case to Court, as our client’s employers refused to put forward an offer of compensation. The Judge found that they failed to carry out a risk assessment or provide suitable equipment for the job, and that there was a breach of the Manual Handling Regulations. He therefore found in favour of our client and awarded damages in respect of his injury.
