Substantial Compensation Settlement in Serious Injury Claim

10th July 2009

Our specialist personal injury lawyers recently acted on behalf of a man who was badly injured in a serious accident at work, resulting in the loss of his lower leg.

Injured at Work

At the time of his workplace accident, our client was using a crane to move a large steel plate which weighed approximately one ton. The grab holding the plate came away, even though its jaws should not open until a clip is released, and the heavy plate crashed down onto his foot and lower leg.

Unfortunately, the injuries to our client’s leg were so severe that it could not be saved and a below-knee amputation was necessary. This serious injury meant that our client was left permanently disabled and with very limited employment prospects for the future.

Our client has had to come to terms with a complete change in lifestyle, as his mobility is now restricted and he requires help from friends, family members and service providers with many domestic tasks that he would previously have carried out himself. His social life and leisure activities have also been badly affected and he continues to suffer from phantom pains. Extensive medical treatment and modifications to his home were required, together with crutches, a wheelchair and other equipment for when it is not possible to use a prosthetic limb.

Compensation Claim for Loss of Limb

The claimant felt that his employer was responsible for the accident, as they failed to ensure his health and safety by providing equipment that was in good working order. Our lawyers specialise in all areas of personal injury, including cases involving accidents at work, factory accidents and catastrophic injuries, so he appointed us to assist him in making a personal injury claim.

Liability was admitted by his employer and negotiations were made on his behalf in respect of a settlement of damages. We were able to secure an interim payment for the claimant to meet his financial needs whilst this process took place.

Our client received £750,000 compensation in total. This sum took into account the pain, suffering and loss of amenity he endured and also his financial losses; such as his loss of past and future earnings, the costs of medical care, equipment, services, rehabilitation, medication and the repayment of government benefits he received.
