A woman left with a long-term shoulder injury due to an accident at a market received compensation, in a recent personal injury claim pursued by our specialist lawyers.
Our client was shopping at an outdoor market at the time of her accident. As she passed one of the stalls, a large, metal pole fell from the top of it and struck her with force.
The pole fractured her shoulder and also caused pain in her head and neck. Although she had treatment including physiotherapy, acupuncture and injections into her shoulder she has been left with ongoing pain and restricted movement, which affect her daily life. She requires help with household chores and personal care and at times her sleep is disrupted.
Prior to her personal injury, our client was employed in a physically active role at a factory. Following the accident however she had to take a lot of time off to recover and, upon her return, was forced to change to lighter duties and could no longer take on overtime. She therefore also incurred a loss of earnings.
Our client felt that the stallholder was responsible for her accident, as he failed to ensure that it was safe, and she approached our expert personal injury lawyers for help with a compensation claim.
We contacted the other side and put forward details of the circumstances of the accident and medical evidence of the injuries sustained. The Defendant accepted liability, however their initial offer of compensation was low in consideration of the severity of our client’s injury. We obtained an interim payment on her behalf to help her financially until a final settlement could be agreed upon and, after negotiations, we were able to secure a total of 30,000 in damages before the case progressed to Court.
