Barry McQuaid, a Senior Operative working for Constellation Europe Limited in Bristol, suffered an accident at work in July 2006 when he fell down a set of metal steps at work. He pursued a personal injury claim and secured £1,300 in compensation.
Mr McQuaid had attended to a problem with the machine that he was working on. To access the fault, he needed to climb the steps of the machine. On his return, he suddenly fell from halfway up the steps, causing him to injure his shoulder, back and arm.
An engineers manual had been left by another employee on one of the steps. The manual was shiny and would usually be placed next to the machine. It should not have been left on the steps where it presented an obvious tripping or slipping hazard.
Mr McQuaid secured £1,300 in compensation for his injuries. Although he was able to return to work after three weeks, his injuries were initially very painful.
Mr McQuaid says: “Initially, I was shaken up. I had grazes on my arms and I started to suffer from a burning feeling on my arm as well as shooting pains in my lower back. I was in agony for a few days and was given painkillers by my GP.”
Claire Speed of Thompsons Solicitors in Bristol, lawyers for The Legal Line, who represented Mr McQuaid, said: “Every employer has a responsibility to keep walkways and floor surfaces clear from any obstructions which could cause a person to trip or fall. An employer is responsible for the acts of their employees, where an employee was negligent in the course of his or her employment.”
