A long-term problem with oil leaking from a machine caused an employee to fall and suffer a nasty knee injury. We represented him in a personal injury claim against his employer and he received compensation.
Our client was working in a basement area at his workplace. He had to stretch over to access an awkwardly positioned part of a machine and he slipped and lost his footing due to oil spilt on the floor. He had not seen that the oil was there because the basement was not well lit.
He fell, dislocating his kneecap and damaging the surrounding ligaments. He had to wear a full leg cast for the initial part of his treatment, then needed a course of physiotherapy. This personal injury rendered him unable to drive or work in his normal capacity for a number of weeks and he could not visit the gym or go out running. He was also left with an increased chance of his knee dislocating again in the future.
The oil that caused our client’s workplace accident was leaking from a machine above the area where he was working. It was found that this had been ongoing for quite some time and other employees had fallen because of it previously, one of whom was also injured. There were trays laid out on the floor to catch the oil, but these would often overflow.
We pursued a compensation claim on behalf of the injured man, as his employer failed to provide a safe workplace. They admitted that they were responsible for the accident and also implemented better health and safety measures, including a system of cleaning the oil away.
Our client received £5,000 in damages. This took into account evidence we put forward about his injury, loss of earnings and the costs he incurred because of the accident.
