A woman who tripped and fell due to a defect in the road received compensation, after our specialist personal injury lawyers pursued a claim on her behalf.
Our client was crossing the road with her family when her foot twisted over into a large pothole in the road, causing her to fall to the ground.
She was immediately in a lot of pain and visited hospital to be examined, where it was confirmed she had a fractured ankle. She had to use crutches for approximately 4 months, then used a walking stick for some time, and has been left with long-term problems with her ankle, despite undergoing a variety of treatments. This has affected her previously active lifestyle and social activities.
The claimant appointed our lawyers to assist her in making a personal injury claim. We began a claim against the local authority, however they tried to deny that they were at fault, stating that inspections had been made two and a half months and nine months before our client’s accident and no dangerous defects were seen. We therefore pursued the case to Court.
We provided evidence from witnesses, who had also fallen due to the same hole before these inspections were carried out, and the Judge also found it was unlikely the road surface could have dropped by so much in the short time since the last inspection.
It was therefore found that the inspection had not been carried out thoroughly enough and it was likely the inspectors had been concentrating mainly on the pavement. Our client was awarded a sum of damages in respect of her personal injury.
