With help from our specialist personal injury lawyers, a police mechanic recently recovered compensation for occupational deafness caused by vehicle sirens.
As a workshop mechanic for the police, our client’s job involved repairing police vehicles and also testing and repairing their sirens. Naturally, in order to do this he had to switch the sirens on to check that they were functioning correctly.
Generally sirens does not pose a hazard to emergency service employees, however the claimant was exposed to the noise for prolonged periods at close range each day.
He began to suffer problems with his hearing and was subsequently diagnosed with noise induced hearing loss.
The claimant felt that his employer was responsible for the damage to his hearing, so appointed our lawyers, who are experts in industrial disease, to assist him in making a personal injury claim.
It was calculated that he was exposed to excessive noise from the sirens for 6.5 minutes per day over a period of more than 20 years without adequate protection. Taking into account factors including the Noise at Work Regulations, it was found that the claimant’s exposure was above the allowed threshold and his employer was in breach of the law and their statutory duty.
The Judge found in favour of our client and he was awarded compensation.
