We recently represented a woman injured in a hotel accident in a personal injury claim. Our lawyers received compensation on her behalf in respect of the ankle injury she sustained.
Our client was using the ladies’ toilets at a hotel where she was a guest. They were furnished with an automatic lighting system, designed to activate when movement was detected and turn off after a set period.
Unfortunately, the sensor was in the room outside the toilet cubicles and the lights could not be reactivated from inside them when it turned out. Therefore, our client was left in total darkness within a cubicle and she stumbled and fell.
As a result of the accident she suffered a fractured ankle.
Our lawyers acted on behalf of the injured woman in a claim against the hotel, on the basis that they did not employ sufficient health and safety measures to avoid injury to their guests.
It was necessary to pursue the case to court, as the hotel did not admit liability. The Judge agreed that the location of the sensor was not suitable and there should have been a warning sign to alert users the lights would turn off after a certain amount of time. Our client was therefore awarded an sum of damages.
