We recently pursed a personal injury claim for a woman who was injured in a fall whilst visiting some holiday cottages. She received compensation for a wrist injury.
Our client went to the premises to make a payment and was invited to look around by a member of staff. She was walking across a courtyard area, when she slipped and fell because there was algae on the surface of the paving slabs.
She injured her wrist as she landed and was immediately in a lot of pain. Her husband took her to hospital and an x-ray confirmed her wrist was badly fractured. An operation was necessary to wire the bones together, then our client had to wear a plaster cast for several weeks.
Because of her personal injury, she needed help from her family with things like shopping, personal care, cooking and getting around until she regained the use of her hand and wrist. She continued to suffer aching in her wrist for more than a year and her grip was not as strong as before. There were also permanent scars from the operation.
The accident could have been avoided if the owners of the holiday cottages had made sure their courtyard was in a safe condition. The injured customer therefore approached us for help with a compensation claim and we took on the case.
The defendants made some initial offers of compensation, but they were not reasonable considering the severity of our client’s injury, so we advised her to reject them. They also tried to allege that she was partly responsible for the accident, even though she was wearing sensible shoes with rubber soles and had done nothing wrong.
We provided evidence of our client’s injury and how it was sustained and successfully negotiated with the other side for an increased offer. She received £8,750 in damages.
